Planning: A revised Use Class Order and changes to Permitted Development

Changes to the Use Class Order and General Permitted Development Rights Order came into effect on 1st September 2020. The changes are a result of the Governments intention to enable a repurposing of buildings on high streets and town centres. New uses have been introduced to the Use Class Order together with a reclassification of some existing uses.

The General Permitted Development Rights Order has been amended and of particular note are new rights to demolish existing commercial buildings and replace them with either a detached block of flats, or a purpose-built detached house and the right to additional storeys (upward extensions) to existing residential single and two storey buildings.

These changes are currently subject to judicial review. It is anticipated that the challenge will be heard during the period 8 – 15 October 2020.
